These Online Store & Product Referral Terms and Conditions ("Store Terms") apply to your use of the online shopping features of the website operated by KMW Corp Pty Ltd trading as Aviation Simulator Technology & Crew Shop ("we", "us", "our").

• we are responsible for arranging fulfilment and delivery where applicable;

You should contact the Supplier directly regarding:

• faulty or defective Supplier Products;
• products that are not as described;
• incorrect products;

• change-of-mind returns;
• refunds;

• warranty claims.

Nothing in these Store Terms is intended to exclude, restrict or modify any right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable law.

Unless expressly stated otherwise, we act as a referral and information provider in relation to Supplier Products.

We are not the manufacturer, seller, distributor, importer, fulfilment provider or warranty provider for Supplier Products merely because those products are displayed on our website or because we provide a link to the Supplier.

We do not take possession of Supplier Products as part of your purchase from the Supplier.

We do not control the Supplier's business, website, pricing, inventory, payment processing, delivery services, returns process or customer service.

If you purchase a Supplier Product directly from a Supplier, any dispute concerning the purchase should generally be raised directly with the Supplier.

This includes disputes concerning:

• product quality;
• product safety;
• delivery;
• returns;
• refunds;
• warranties;

Unless otherwise stated, prices include GST where GST is applicable.

14.2 Order submission and acceptance

When you submit an order for a product sold directly by us, you are making an offer to purchase the selected products.

An automated order acknowledgement confirms receipt of your order but does not necessarily constitute acceptance.

Estimated delivery times are estimates unless we expressly state that a particular delivery date or timeframe is guaranteed.

If a product is not supplied within an agreed timeframe, or within a reasonable time where no timeframe has been agreed, you may have rights under the Australian Consumer Law.

Our Returns, Refunds & Consumer Guarantees Policy applies to products purchased directly from us.

Our products come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Store Terms or our Returns Policy limits or excludes those rights.

Where applicable, you may have rights to a refund, replacement, repair or compensation depending on the circumstances and the nature of the failure.

Unless otherwise stated in our Returns Policy, we are not required to provide a refund or exchange merely because you change your mind.

Where we voluntarily offer change-of-mind returns, the conditions applying to those returns will be set out in our Returns Policy.

Those conditions do not limit or affect your rights where the Australian Consumer Law applies.

If you receive a product purchased directly from us that is damaged, defective, incorrect or materially different from what you ordered, please contact us as soon as reasonably practicable.

We will assess and deal with the issue in accordance with applicable law and our Returns, Refunds & Consumer Guarantees Policy.

We may occasionally provide promotions, discount codes or referral offers relating to products sold directly by us or products supplied by third parties.

Additional conditions may apply to individual offers.

Where a referral code is provided for a Supplier Product, the code may simply identify that the customer was referred by us. The code does not mean that we are the seller of the product or a party to the customer's purchase contract with the Supplier.

Nothing in these Store Terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

In particular, nothing in these Store Terms:

removes or limits rights available under the Australian Consumer Law;

represents that a consumer has fewer rights than they actually have; or

prevents a customer from exercising a legal right against the party responsible for the relevant transaction.

We may take reasonable steps to prevent fraud, unauthorised transactions, misuse of promotions and other unlawful or improper use of our online store.

We may suspend or restrict access to our online store where reasonably necessary for security, legal or operational reasons.

If you purchase products for business or commercial purposes, additional terms may apply.

Nothing in these Store Terms excludes any rights that apply under the Australian Consumer Law where the purchaser qualifies as a "consumer" under that legislation.

Personal information submitted to us in connection with products sold directly by us will be handled in accordance with our Privacy Policy.

Where you follow a link to a Supplier's website, the Supplier may collect your personal information directly.

The Supplier's privacy policy will apply to personal information collected by the Supplier.

Nothing in these Store Terms excludes, restricts or modifies any right, guarantee, warranty, condition or remedy that cannot lawfully be excluded, restricted or modified.

To the maximum extent permitted by law, we are not responsible for loss arising solely from a Supplier's acts or omissions in connection with a transaction between you and that Supplier.

This includes, where applicable, matters relating to a Supplier's:

• product;
• pricing;
• stock;
• payment processing;
• delivery;
• returns;
• refunds;
• warranty;
• customer service; or
• fulfilment.

This clause does not exclude liability arising from our own conduct where that liability cannot lawfully be excluded or limited.

These Store Terms are governed by the laws of Queensland, Australia.

Any dispute will be dealt with in accordance with applicable Australian law and any mandatory rights available to you.
