Additional terms may apply to particular products, services, promotions or transactions conducted through the Website. Where you purchase products through the Website, the Online Store Terms also apply.

In particular, nothing in these Terms excludes or limits rights available to consumers under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.

To the maximum extent permitted by law, we exclude liability for loss or damage arising from your use of the Website where that loss or damage could reasonably have been avoided by you exercising reasonable care or following information provided by us.

Nothing in these Terms excludes liability to the extent that doing so would be unlawful.

Where the law permits us to limit our liability, our liability will be limited to the maximum extent permitted by law.

Nothing in this clause limits or excludes our liability for:

  • fraud or fraudulent misrepresentation;
  • death or personal injury caused by our negligence where liability cannot lawfully be excluded;
  • a breach of the Australian Consumer Law that cannot lawfully be excluded or limited; or
  • any other liability that cannot lawfully be excluded or limited.
13. Indemnity

To the extent permitted by law, you agree to indemnify us against losses, liabilities, costs and expenses reasonably incurred by us as a result of your unlawful use of the Website or your breach of these Terms.

This indemnity does not apply to the extent that the relevant loss was caused by our own negligence, unlawful conduct or breach of a non-excludable obligation.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be read down to the extent necessary, and if it cannot be read down, it will be severed to the extent permitted by law.

The remaining provisions will continue to apply.

16. No waiver

A failure or delay by us to exercise a right under these Terms does not constitute a waiver of that right.

17. Governing law and jurisdiction

These Terms are governed by the laws of Queensland, Australia.

Subject to any applicable mandatory consumer rights, the courts of Queensland have jurisdiction in relation to disputes arising from or relating to these Terms or your use of the Website.
